Terms of Service

These Terms of Service (hereinafter "Terms") govern access to and use of the Osabana platform, operated by Greenars LLC, based in the United States. By registering or using our services, you accept these Terms in their entirety.

1. Definitions

  • Platform: the Osabana website, mobile application, and services.
  • User / Customer: any person who accesses, registers, or uses the Platform.
  • Store: each e-commerce store hosted on the Platform.
  • Merchant: person or company that operates a Store on the Platform.

2. Registration and Account

To make purchases, you must create an account by providing accurate and up-to-date information. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activities that occur under your account.
  • Immediately notifying us of any unauthorized use.

We reserve the right to suspend or cancel accounts that violate these Terms.

3. Eligibility

You must be at least 13 years old to use our services. If you are under 18, you must have authorization from a parent or legal guardian.

4. Orders and Purchases

  • Product prices and availability are subject to change without notice.
  • An order is considered confirmed once payment has been successfully processed.
  • We reserve the right to reject or cancel orders in cases of pricing errors, stock unavailability, or suspected fraud.
  • Applicable taxes are calculated and displayed during the checkout process.

5. Payments

We accept the payment methods enabled in each store (credit/debit cards, PSE, Nequi, cash on delivery, among others). Payments are processed by third-party providers (Wompi) under their own terms of service and PCI-DSS security standards.

6. Shipping and Delivery

  • Shipping times and costs are calculated during checkout based on the delivery address.
  • Estimated delivery times are indicative and may vary by logistics provider.
  • Risk of loss or damage transfers upon delivery.

7. Returns and Refunds

Return and refund policies are set by each Merchant individually and are displayed in their store. Refunds are generally processed using the same payment method used for the purchase.

8. Account Deletion

You may delete your account at any time from your account settings in the application or from our account deletion page. Upon deleting your account:

  • Your personal data will be permanently anonymized.
  • Transaction records are retained in anonymous form for legal obligations.
  • Deletion is irreversible.

9. Intellectual Property

All Platform content (design, code, logos, text, images) is the property of Greenars LLC or its licensors. Reproduction, distribution, or modification without express authorization is prohibited.

10. User Conduct

When using the Platform, you agree not to:

  • Provide false or fraudulent information.
  • Interfere with Platform operations.
  • Access systems or data without authorization.
  • Use the Platform for illegal activities.
  • Infringe third-party intellectual property rights.

11. Third-Party Services

The Platform uses third-party services (payment processors, shipping services, analytics) that are subject to their own terms and conditions. We are not responsible for the practices or policies of such third parties.

12. Limitation of Liability

To the extent permitted by law, Osabana shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the Platform. Our total liability shall not exceed the amounts paid by you in the preceding 12 months.

13. Service Availability

We strive to keep the Platform continuously available but do not guarantee uninterrupted operation. We may perform scheduled or emergency maintenance without prior notice.

14. Privacy

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

15. Modifications

We reserve the right to modify these Terms at any time. Significant changes will be notified via email or notice on the Platform. Continued use after changes implies acceptance.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States of America. Any disputes shall be submitted to the competent courts, unless applicable consumer protection law provides otherwise.
